1. Agreement

By creating an account on Prognosist (the "Service") or by browsing its public pages, you accept these Terms of Use. If you do not accept them, do not use the Service.

These Terms work together with our Privacy Policy, which forms an integral part of the agreement between you and us.

2. Eligibility

You must be at least 18 years old to register or use any feature of the Service that involves tracking predictions or virtual coins. By registering you confirm that you meet this age requirement.

3. Your account

You're responsible for keeping your password and any social-login credentials confidential.
You are responsible for activity that happens under your account.
One person, one account. Multi-account use to manipulate the leaderboard is prohibited.
Notify us immediately through our contact form (subject: Other) if you suspect unauthorised access.

4. Virtual coins have no real-world value

The Service uses an in-house virtual currency ("coins") to track tipster prediction accuracy. Coins are not money. They cannot be exchanged for cash, goods, services or any other thing of value. They have no monetary worth. We may, at our sole discretion, grant, adjust or revoke coin balances to fix bugs, reverse abusive activity or operate platform-wide adjustments (for example, season resets).

Nothing on the Service constitutes wagering or gambling under any applicable law.

5. Predictions are informational

Our predictions, value-bet flags, AI-generated commentary and statistical content are provided for information and entertainment only. They are not financial advice. They are not a guarantee of any specific outcome. Past prediction performance does not guarantee future results. We accept no liability for any losses, financial or otherwise, that you may incur as a consequence of decisions you make based on the Service's content, including bets placed on third-party platforms.

6. Acceptable use

You agree not to:

Register or operate automated accounts, "spam" accounts, or accounts whose primary purpose is bypassing rate limits
Scrape, crawl, or harvest content at scale for redistribution; reasonable personal research is fine
Reverse engineer, decompile, or attempt to extract source code from our applications
Attempt to gain access to other users' accounts
Probe, scan, or test the vulnerability of our infrastructure without prior written permission. For responsible disclosure, please use our contact form and pick the Bug report subject.
Post content that is illegal, threatening, harassing, defamatory, or that infringes third-party rights
Use the Service to provide regulated financial services to third parties

7. Suspension and termination

We may suspend or terminate any account that breaches these Terms, with or without prior notice. Where notice is reasonable we will provide it. Activity we treat as serious breach includes spam accounts, attempts at multi-accounting, infrastructure abuse, and harassment of other users.

You may close your account at any time from your account settings. On account closure your personal data is removed per the schedule in the Privacy Policy.

8. Intellectual property

The Service's design, code, models, prediction outputs and original editorial content are owned by us or our licensors. You may not copy or reuse them at scale without our written permission.

You retain ownership of content you post (e.g. forecast commentary). By posting it on the Service you grant us a non-exclusive, royalty-free, worldwide licence to display, store and distribute that content as part of the Service.

Sports data is provided under licence by our data partners; reuse outside the Service requires their permission, not ours.

9. Disclaimer of warranties

The Service is provided "as is" and "as available". To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure or error-free, or that predictions or statistics will be accurate or complete.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service, including but not limited to lost profits, lost data, lost bets, or business interruption. Our total cumulative liability to you for direct damages is capped at €50 or the equivalent in local currency.

11. Governing law and disputes

These Terms are governed by the law of the country where the operating team is established (currently Poland), excluding its conflict-of-laws rules. Any dispute arising out of the Service is subject to the exclusive jurisdiction of the competent courts of that country, except where you, as a consumer in the EU, have non-waivable rights to bring proceedings in your country of residence.

12. Changes to these Terms

We may update these Terms to reflect changes in regulation, product features or operational reality. Material changes are announced in-app or by email to registered users. The "Last updated" date at the top of this page is authoritative. Continued use of the Service after a material change constitutes acceptance of the new Terms.
